AGREEMENT made this 21^st day of December, 1981 by and between the Local Labor Committee of the National Elevator Industry, Inc., and Local Union No. 4 of the International Union of Elevator Constructors for the purpose of establishing expense allowances and rates for automobile mileage.

This Agreement to become effective December 21, 1981, and shall remain in effect for a period of thirty (30) months, continuing thereafter as long as satisfactory to both parties. Sixty (60) days notice in writing shall be given by either party of their desire to change the Agreement and such written notice shall constitute cause for meeting of both parties.

Room and board will not be paid on jobs located in the 22 wards of Boston or within a radius of 7 ½ miles from the State House, Boston. The Champion #379 Map of Boston will be used to determine the primary boundary.

Travel expenses after the first stop of the day will be paid by the employer. If the employee first reports to the shop, that is the first stop of the day. This district includes all of the following cities and towns: Boston, Brookline, Cambridge, Chelsea, Everett, Malden, Medford, Somerville and Winthrop.

The following cities and towns are included in part within the 7 ½ mile radius: Arlington, Belmont, Melrose, Milton, Newton, Quincy, Revere, Saugus, Stoneham, Waltham, Watertown and Winchester.

Room and board will not be paid on jobs located in the 22 wards of Boston or within a radius of 8 miles from the State House, Boston. The Champion #379 Map of Boston will be used to determine the primary boundary.

Travel expenses after the first stop of the day will be paid by the employer. If the employee first reports to the shop, that is the first stop of the day. This district includes all of the following cities and towns: Boston, Brookline, Cambridge, Chelsea, Everett, Malden, Medford, Revere, Somerville and Winthrop.

The following cities and towns are included in part within the 8 mile radius: Arlington, Belmont, Lynn, Melrose, Milton, Newton, Quincy, Saugus, Stoneham, Wakefield, Waltham, Watertown and Winchester.

Similar zones shall be established around permanent offices outside of Boston for the regular employees of these offices while performing repairs and contract service.

The secondary jurisdiction and beyond shall be divided into five zones:

7 ½ miles to approximately 15 miles

8 miles to approximately 15 miles

Approximately 15 miles to 25 miles

Approximately 25 miles to 35 miles

Approximately 35 miles to 50 miles

Approximately 50 miles and beyond

No attempt is being made in this Agreement to claim any territory that is not in the jurisdictional award to Local No. 4.

There are cities and towns listed in this Agreement beyond the jurisdiction of Local No. 4. They are listed to establish zone expense only and are underlined for identification.

On jobs requiring only one day beyond Primary Jurisdiction, lunch expense of $2.00 will be paid. If work on job extends beyond 6:30PM, not including travel time, supper expense of $4.00 will be paid. Time out for lunch or supper shall not be charged as working time.

This zone includes parts of the following cities and towns beyond the 7 ½ mile radius: Arlington, Belmont, Melrose, Milton, Newton, Quincy, Revere, Saugus, Stoneham, Waltham, Watertown, Winchester.

Also, all of the following cities and towns: Bedford, Braintree, Burlington, Canton, Cohasset, Dedham, Dover, Hingham, Holbrook, Hull, Lexington, Lincoln, Lynn, Lynnfield, Marblehead, Natick, Needham, Norwood, Peabody, Randolph, Reading, Salem, Swampscott, Wayland, Wakefield, Weymouth, Wellesley, Westwood, Weston, Woburn, Wilmington.

This zone includes all of the following cities and towns: Acushnet, Ashby, Auburn, Berkeley, Carver, Dighton, Douglas, Fall River, Fitchburg, Freetown, Holden, Lakeville, Leicester, Leominster, Lunenberg, Marion, Millbury, New Bedford, Oxford, Paxton, Pepperell, Plymouth, Princeton, Rehoboth, Rochester, Rutland, Seekonk, Somerset, Sterling, Sutton, Swansea, Townsend, Uxbridge, Wareham, Webster, Westminster, West Boylston, Worcester.

This zone includes all of the following cities and towns: Amherst, Auburn, Bedford, Brentwood, Brookline, Chester, Danville, Derry, Epping, Exeter, Greenland, Greenville, Hampton, Hampton Falls, Hollis, Hampstead, Kensington, Kingston, E. Kingston, Litchfield, Londonderry, Manchester, Mason, Merrick, Milford, Nashua, Newfields, Newton, North Hampton, South Hampton, Raymond, Rye, Sandown, Seabrook, Stratham.

This zone includes all of the following cities and towns: Barrington, Bristol, Burrilville, Central Falls, Cranston, Gloucester, Johnston, Lincoln, Pawtucket, Providence, East Providence, North Providence, Scituate, Smithsfield, North Smithsfield, Warren, Warwick, Woonsocket.

If residence is maintained away from home during the regular work week and work is to continue on the first work day of the following week, expenses will be paid for all days while assigned to jobs in this zone. The expense week is from Monday to Sunday inclusive.

Expenses listed are minimum rates in the zones. Actual expenses incurred in excess of these rates will be paid by the employer. Proof of excess expenses may be required by the employer.

Zone expense will be paid as they have in the past using the new rates. Each job shall have travel expenses and time at the start and completion of the assignment to the job; i.e., from shop to job; job to shop; job to job within the same day.

Any two or more consecutively worked days shall entitle the man to the zone expense for each worked day from the start to the completion of the assignment to the job.

Initial parking with a maximum of $9.00 shall be paid by the contractor when the constructor is authorized to use his vehicle by the contractor. The Government Center Garage daily parking rate shall be used as the basis for this rate, as long as it is satisfactory to both parties, and shall be reviewed and adjusted semi-annually. The Elevator Contractor will pay the second and all subsequent paring fees incurred during the remainder of that work day. Receipts may be required by the employer.

Men operating personally owned means of transportation when they agree to drive their cars on Elevator Contractors business shall have the minimum personal injury $5/10,000.0o insurance limit, extra territorial, and $5,000.00 property damage.

Any extra cost for insurance coverage required by the Elevator Contractor shall be paid for by the Elevator Contractor.

When the Elevator Constructor agrees to use his/her personal vehicle on company business, the reimbursement rate shall be 28 cents per mile, effective December 21, 1981. It is also agreed that in the event gasoline prices increase or decrease, a formula shall be applied for the computation of the per mile allowance. Using $1.360 per gallon as the price of regular unleaded gasoline as of December 21, 1981, for every 6 cent increase the per mile allowance will be increased by 1 cent. For every 6 cent decrease, the per mile allowance will be decreased by 1 cent. No per mile payment change shall take place more than once in 60 days. AAA combined prices for unleaded regular gasoline in the Metropolitan area shall be used to establish this rate.

The Elevator Contractor will pay 4 cents per mile to the driver for each additional person transported by him.

Men using public transportation shall be paid the established rate of that conveyance, i.e., bus, taxi, train, etc.

All tolls paid by the employee shall be reimbursed by the employer. The Milo Mileage Guide New England Motor Rate Bureau shall be used as a guide. If a dispute arises, it will be settled between the employer and the Union Business Manager.

It is agreed that Elevator Constructors working continuous time beyond the Primary Jurisdiction previous to the holiday shall not be paid overtime rate for days not listed as holidays in the district in which they are working.

Dear Mr. Treadway:

The Purpose of this letter is to set forth the understanding of NEII and the IUEC relative to the payment of overtime for travel tie as follows:

If the majority of the time spent on overtime work involves finding the cause of the trouble rather than correcting the problem, then all the overtime hours will be considered as cal-back time and paid at the applicable rate. On the other hand, if the majority of the time spent by the employee involves the correction of the problem rather than finding the cause of the trouble, then all overtime hours will be considered as repair work and paid at the applicable rate. As a general rule the overtime travel time is to be paid as follows:

It is understood and agreed that where a man has worked for more than one company and has worked at least 1750 hours entitles him to the minimum vacation pay guaranteed by Article XII. The obligation to pay minimum Vacation Pay shall be prorated between all the companies for whom the man worked based upon the hours the man worked for each company. The determination regarding a proration shall be made as of the end of the Vacation year December 31.

   Agreement made this twelfth day of December 1962 by and between the Local Labor Committee of the National Elevator Manufacturing Industry, Incorporated and           Local No. 95 of the International Union of Elevator Constructors for the purpose of establishing expense allowance, overtime traveling and rate for automobile mileage.

                                              PRIMARY JURISDICTION

   Primary jurisdiction of Local No. 95 of the City of Portland, Maine relative to the wage scale and working conditions shall include all the City of Portland, Maine and within a seven-mile radius of the City Hall including the City of Westbrook.

                                                           ZONE 1

   Zone 1 is that area which extends fifteen (15) miles beyond the perimeter of the Primary Zone.

   Men working eight (8) hours on the job and traveling to or from the job outside of regular straight time working hours, shall receive 1/3 hour allowed traveling time x 1 ½ = ½ hour.

   On jobs requiring one day beyond the primary Jurisdiction, expenses incurred during that one day shall be paid by the Employer.

   Employer shall require proof of expenses incurred in excess of rates listed in this Agreement before same will be paid.

   Each job shall have travel time and travel expense at start and completion of assignment to each job.

   Travel time and travel expense shall not be charged in place of expense on weekends.

   Expense week is from Monday to Sunday inclusive.

   It is agreed that men working under jurisdiction of Local No. 95 receive __________ per mile when they agree to use their personally-owned vehicles when authorized by Elevator Contractor to do so.

   The Elevator Contractor will pay $.04 (four cents) per mile to each additional man transported by him.

   Men using public transportation shall be paid the established rate of that conveyance.

   Men operating personally-owned means of transportation, and on Elevator Contractors’ business, shall have the required insurance coverage. The minimum personal injury $5/10,000.00 insurance limit, extra territorial, and $1,000.00 property damage, with policy written so as to permit use of personally-owned means of transportation for business and pleasure, with interest of Elevator Contractor included. The Elevator Contractors requiring employees to carry insurance beyond the limits called for in this Agreement, agree to pay to the employee the difference in and between the Contractors’ requirements and the amount of insurance coverage as set forth in this Agreement.

   This Agreement shall be enforced from effective date and shall continue as long as satisfactory to both parties. Thirty (30) days notice shall be given either party of a desire of such a change, and such written notice shall constitute a cause for a meeting of both parties.

                                               Effective date is January 2, 1963 .
